Kenneth Hite appeals the victim penalty assessment imposed for his conviction of third degree assault of a child. Hite committed the offense between May 1, 1993 and May 1, 1996. An amendment to RCW 7.68.035(1)(a), effective June 6, 1996, raised the amount of the victim penalty assessment from $100 to $500. Hite was charged and found guilty of this offense in 1998. When Hite was sentenced on February 13, 1998, the trial court assessed the higher penalty amount. In State v. Humphrey, the Supreme Court held that the 1996 amendment must be applied prospectively only to offenses committed on or after June 6, 1996.The trial court therefore erred in imposing the higher assessment in this case. The victim penalty assessment is vacated and the case remanded for entry of a corrected judgment and sentence.
