Richard Hirschfield appeals his conviction for one count of rape of a child in the first degree and one count of child molestation in the first degree. Because the trial court did not abuse its discretion in finding that the child witness was "unavailable" and the State made a "good faith effort" to produce that witness to testify, the witness hearsay testimony was admissible. Moreover, the trial court did not abuse its discretion in denying Hirschfields request to proceed pro se on the eve of trial. Finally, there is sufficient evidence of penetration to support the conviction. We affirm.
