Martin Dies, Jr., the Beaumont Court of Appeals upheld the jurys verdict finding Robert Wayne Preston, appellant, guilty of committing the offense of aggravated assault on a peace officer. See Preston v. State, S.W.2d (Tex.App.- Beaumont, No. 09-83-003 CR, September 7, 1983). The trial court had assessed punishment at ten years confinement in the Department of Corrections, but ordered same probated.
